Advise and represent clients on all aspects of international arbitration proceedings under institutional and ad hoc rules (including, ICC, ICSID, AA/ICDR, CIARB, LCIA, and UNCITRAL rules).
Advise on court proceedings brought in support of arbitrations under the federal arbitration act including court proceedings to enforce arbitration agreements, and challenge, confirm, recognize, and enforce arbitral awards.
Advise on international arbitration and alternative dispute resolution matters, focusing on commercial arbitration disputes, investor-state disputes, and projects, energy, mining, infrastructure, and construction matters.
Draft, comment, and advise on arbitration agreements clients are considering during contract negotiation and draft memoranda of advice on international arbitration issues related to arbitration agreements contained in executed contracts or triggered by potential disputes.
Provide advice on investment in international arbitration, including merits assessment of arbitration claims and awards and advice.
Provide assistance to attorneys in dispute resolution group.
Draft requests for arbitration, answers to requests, memorial-style pleadings (statement of claim, statement of defense, statement of reply, and statement of rejoinder), post-hearing briefs, and costs submissions.
Prepare for hearings, including drafting of opening statements, closing statements, reviewing of transcripts, cross-examination of witnesses and experts during hearings.
Assist in the selection of arbitrators and expert witnesses.
Advise and represent clients in settlement negotiations, draft settlement agreements and evaluate fulfilment of post-settlement obligations.
Advise transactional colleagues on international arbitration issues affecting transactional deals, including review of dispute resolution clauses.Requirements:•Juris Doctor, Master of Laws degree, or foreign academic equivalent and one year of legal experience involving contentious matters including international arbitration and litigation concerning civil and commercial disputes across a range of industries including oil and gas, pharmaceuticals, telecommunications, and banking.•Experience with the procedural framework of arbitrations, including analyzing the merits of potential arbitration claims and defenses; providing risk assessments; drafting submissions including requests for arbitration, pre-hearing, post-hearing, cost submissions, and pleadings (including statements of claim, statements of defense and counterclaim, reply pleadings, and rejoinders); and reviewing awards.
•Experience drafting and reviewing dispute resolution clauses (including arbitration agreements).
•Experience with the preparation of witness written and oral testimony, including interviewing witnesses and drafting witness statements.
•Knowledge of international arbitration proceedings carried out under the rules of major international institutions, including the International Chamber of Commerce (ICC) and International Center for the Settlement of Investment Disputes (ICSID).
•Experience in investor-state arbitration proceedings and successfully representing investors and states.•Frequent travel (mostly to the UK, Europe, and the Middle East) required for international arbitration hearings and for witness interviews/depositions.
