Position Description
LSHV has an immediate opening in our Peekskill office for an experienced and dedicated full-time Consumer Bankruptcy Staff Attorney to join our dynamic foreclosure prevention team and serve clients throughout our entire service area.
The ideal candidate will have a strong background in bankruptcy law, excellent negotiation skills, and a commitment to providing high-quality legal representation to our clients.
Duties of the Position: individual case work, representation at administrative hearings, litigation in state and federal courts, and education and outreach efforts directed at community members, advocates, and services providers.
The person hired will also be expected to adhere to program and case handling standards, funder requirements, the highest professional standards, and be available as a resource to LSHV staff and access to justice communities.
Key Responsibilities Handle bankruptcy cases from inception to resolution, including Chapter 7, and Chapter 13 filings.
Conduct legal research and provide sound legal advice to clients.
Draft and file bankruptcy petitions, schedules, motions, adversary proceeding complaints and other necessary documents.
Represent clients in court hearings and proceedings virtually and in-person.
Negotiate with creditors, trustees, and other parties involved in bankruptcy cases.
Develop and implement strategies to protect clients' assets and interests.
Stay current with developments in bankruptcy law and regulations.
Maintain accurate and up-to-date case files and documentation in our case management system.
Collaborate with other attorneys and support staff to ensure seamless case management.
Participate in community outreach and education events.
Qualifications Juris Doctor (JD) degree from an accredited law school.
Admission to the New York state bar and in good standing.
Admission to the SDNY.
Three or more years' experience in bankruptcy law.
Proven track record of successfully handling bankruptcy cases.
Strong analytical, research, and writing skills.
Excellent communication and interpersonal skills.
Ability to work effectively under pressure.
Preferred Experience with both consumer and business bankruptcy cases.
Familiarity with local bankruptcy court procedures and trustees.
Three or more years' experience with Chapter 13 cases.
Mediation or negotiation certification.
Salary: $68,351 - $126,373, DOE, union scale, with excellent benefits that include medical, dental, vision, life insurance and long-term disability coverages, as well as a defined contribution to 403b, loan repayment assistance and paid parental leave.
After a brief probationary period, this position may permit work from home up to two days per week.
