The Kings County District Attorney's Office is seeking a qualified attorney to work as an assistant district attorney in the role of Deputy Chief of the Freedom of Information Law (FOIL) Unit.
The FOIL Unit is responsible for all FOIL requests to the Office for records, as well as requests from other agencies (primarily the NYC Law Department) for records.
The position entails overseeing a staff of paralegals, and includes training new staff, reviewing answers to difficult or confusing requests, answering administrative appeals, opposing C.P.L.R.
Article 78 petitions and appearing in court on those petitions, and drafting appellate briefs and appearing for oral arguments when the C.P.L.R.
Article 78 decisions are appealed to higher courts.
The Deputy FOIL Unit Chief also works closely with the Civil Litigation Unit on related litigations.
Successful applicants will be expected to perform duties encompassing various aspects of New York and Federal civil practice, including: representing the Office in civil litigation matters and conducting civil motion practice; coordinating with the NYC Law Department in response to civil actions filed against the Office; preparing and defending witnesses at civil depositions; negotiating and drafting civil settlement agreements and other civil contracts entered into by the Office, and representing the Office in administrative hearings pursuant to Section 75 of New York State's Civil Service Law (which covers terminations and disciplinary actions) as well as other employment law matters.
Qualified candidates must:
Be an attorney admitted to practice in the State of New York with at least 3 years of experience; Have strong writing, research, and analytical skills; Have appellate or other legal writing experience;Have experience making legal arguments in court;Have the ability to work effectively under deadlines; andHave excellent interpersonal and communication skills.
